Desr Mr. Shuey: <br />The Colorado Department of Public Health and Environment (the Departm~tt) bas reviewed a draft <br />copy of, "Gilsorrite Pit, 112 Permit Application to Colorado Mined Land and Reclamation Division, <br />Revised May 2003". This plan was submitted on behalf of Elam Construction, Ync, (Blom), and <br />received by the Department on May 14, 2003. The Deparlmet>t has some minor comments on the plan, <br />which are attached. It is my understanding that these cotameats will be indorporated into the final plan <br />to be submitted to the Division of Minerals sad Geology (DMG}. <br />The area to 6e mined for gravel lies in the southern portion of the Fruits Refinery, which is owned by <br />Fruits Marketing and Management, htc., (FMM), and is currently subject to the requirements of <br />Complisuue Order No. 98.06.05.Ol. Tho Mey 3003 application representm a revised version to address <br />the waarna identified in the DMG's pretiminnry adequacy review (dated Ianuary 2, 2003) of the <br />October 2002 application. Many of DMG's concerns weue related to soil artd groundwater <br />contaatinatioa issues in the area to be mined, In early 2003, rho Depattrnont coordinated meetings with <br />a number of agencies, including the DMG, the Water Quality Control Division, sad the Colorado <br />Division of Wildlife, and FMM, Elam, and their consultant (Greg Lewicki land Associates). The <br />primary objectives of these maotirtgs were to clarify the existing environmental characterization of the <br />area, and to revise the mining strategy and to improve/modit~ plans to bettor manage existing <br />hydrocarbon and other contamination at the site during mining. <br />As a i~eault, the Department believes that the May 2003 apglication is a muoh-improved mhting plan <br />with respect to managing Contaminant issues.
