M-2004-044
Members of the Board:
On December 29, 2004, the Division sent to the Board a recommendation for approval and
rationale for recommending approval of this application over objections. The recommendation
for approval included four (4) conditions. The Division finds it necessary to add a fifth condition
of approval, in order to insure Aggregate Industries' compliance with Exhibit S.
5. Aggregate Industries shall not affect land south of and within 200 feet of the Todd Creek
Farms water supply pipeline and shall not further affect land within 200 feet of the north
side of the pipeline, in the Phase 2A area, except for reclamation work, until a notarized
agreement between Aggregate Industries and Todd Creek Farms stating that Aggregate
Industries is to provide compensation to Todd Creek Farms for any damage to the
pipeline, or Aggregate Industries otherwise complies with the requirements of Rule
6.4.19(b) or (c).
This additional condition is necessary because, the pipeline has been installed, since the Division
made the original recommendation for approval with conditions.
Sincerely,
~~~~
Larry .Oehler
Environmental Protection Specialist
Cc: Harry Posey, DMG
Steve Brown, DMG AGO
Tyson Powell, MLRB AGO
Parties, by distribution at the Hearing
Karen Flanders, Tetra Tech-RMC
Office of Office of Colorado
Mined Land Reclamation Active and Inactive Mines Geological Survey
