<br /> <br />Permit No. 78-85 <br />MINED LAND RECLAMATION BOARD <br />Department of Natural Resources <br />1313 Sherman Street, Room 723 Telephone: 892-3567 <br />Denver, Colorado 80203 <br />DEVELOPMENT AND E7CTRACTION MINING PERMIT <br />THIS PERMIT is issued this 25th dap of May, 1978 by the Mined Laad <br />Reclamation Board, Department of Natural Resources, state of Colorado. <br />1?ITNE S S ETH <br />WHEREAS, Moffat County <br />operation, known sa smith Pif (1120) <br />mined sand & gravel and <br />desires to conduct a(n) open mining <br />, for the purpose of extracting <br />WHEREAS, on March 21 , 1978 , Moffat County "PILED" as apP~- <br />cation, a reclamation plan and map, and the required fee, as required by law; and <br />WHEREAS, on May 25 , 1978 , the Mined Land Reclamation Board approved <br />Moffat County's application and net bond; and <br />WHERtAS, on May 25 , 19 7g, the Mined Land Reclamation Board accepted surety <br />submitted by Moffat County sad such date shall be considered the <br />date o£ issuance of the permit sad the anniversary date for all other purposes; and <br />WBEREAS, the Mined Land Reclamation Board has made a finding, for the purposes <br />of issuing this permit, that; <br />1) the application complies with the requirements of the Colorado <br />Mined Land Reclamation Act and all applicable local, state and <br />Federal laws; and, <br />2) the operation will not adversely affect the stability of nay <br />sigalficaat, valuable, and permanent man-made structures located <br />within two hundred feet of the affected lead, except where there <br />is as agreement between the operator and the persons having as <br />intareat in the structure that damage to the structure is to be <br />compensated for by the operator; and, <br />3) the proposed mining operations sad reclamation can be carried out <br />is conformance with the requirements of C.R.S. 1973, 34-32-116, <br />as amended (1976 Sesa. Laws H.B. 1065); and <br />WHEREAS, for the purposes of issuing this permit, the operator has made <br />a satisfactory showing to the Board that he will employ during and after his <br />. open mining operations procedures reasonably designed to mialmize as muc3~ <br />as practicable the disruption from the open mining operations and will <br />provide far the rehabilitation of the affected land through the rehabilitation of plant <br />cover, soil stability, water resources, and other measures appropriate to the <br />subsequent, beneficial use of such mined and reclaimed lands; and that in <br />the event of the failure of his proposed reclamation plan, he will take whatever <br />measures which may be necessary is order to assure the success of :eclamation of <br />the leads affected by his open mining operations; and, <br />WHEREAS, for the purposes of issuing this permit, a copy of the application <br />approved by the Mined Land Reclamation Board of the State of Colorado is attached <br />to this permit sad thereby becomes apart of the terms hereof. <br />NOW, THEREFORE, pursuant to the authority net forth in the Colorado Mined <br />Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, (1976 <br />Seta. Laws H.B: 1065) the Mined Laad Reclamation Board of the State of Colorado <br />hereby issues a life of the mine permit to Moffat County to engage is <br />open mining for the purpose of extracting open <br />mined sand & gravel ~n the following parcel of ground, to wit: <br />An 8 acre tract contained in NEy NEZ of Section 13, T12N, R94W, <br />and the NW's NWT of Section 18, T12N, R93W of the 6th P.M, in <br />Moffat County, Colo. <br /> <br />
