STATEMENT OF RESPONSIBILITY FOR DAMAGE
THIS STATEMENT is made by Ed Loloff Const., Inc., hereinafter known
as "Operator," on this 20th day of August 1985.E
WHEREAS, the Operator has applied for a mining pern{it from the
Colorado Mined Land Reclamation Board for a proposed mi ing operation
in the Southeast Quarter of the Northwest Quarter and t e South Half of
the Northeast Quarter of the Northwest Quarter of Section 4, Township 5
North, Range 65 West of the 6th P.M., said permit appli9ation having
been filed on June 19, 1985; and
WHEREAS, the Operator intends to establish and operate a sand and
gravel mine within the property described above; and
WHEREAS, the Colorado Mined Land Reclamation Divisiln has required
the Operator to formally address, herein, responsibility for damage
caused by the proposed mining operation to offsite struc ures within
two hundred feet of the lands to be affected by mining.
NOW, THEREFORE, the Operator has identified the fol~owing
significant, valuable, man-made structures within two hu dred feet of
the lands to be affected by mining:
1. One residence, one garage, and one small s ed associated
with the property at 665 North Balsam Aven~e, Greeley,
Colorado; and
2. One garage associated with the property at~701 North
Balsam Avenue, Greeley, Colorado; and j
3. A power line supported by utility poles al~ng the eastern
right-of-way line of North Balsam Avenue.
THE OPERATOR HEREBY agrees and promises to compensa$e the owners
of the above listed structures for that damage to said si~ructures which
is directly and clearly caused by the mining operation. Such
compensation and the arrangement therefore will be made ~n accordance
with Colorado State Law.
THE OPERATOR HEREBY offers, as Exhibit "A", a copy ~f a CERTIFICATE
OF INSURANCE for review by interested parties.
