REQUEST: A Use by Special Review Permit for an open-cut gravel pit (public
utility)
LEGAL DESCRIPTION: Pt. S`~ SEz, Section I, T10N, R67W of the Gth P.M „ Weld
County, Colorado
LOCATION: Approximately three and one Half (3.5) miles southeast of the
community of Carr; north of Weld County Road 120 and west of State
Huy 85.
be approved Eor the following reasons:
1. The submitted materials are in compliance with application requirements
of Section 25.7, 44.1, 44.2, and 44.3 of the Weld County Zoning
Ordinance.
2. It is the opinion of the Planning Commission that the applicant has shown
compliance with Section 25.8 et seq. of the Weld County Zoning Ordinance
as follows:
- Reasonable efforts have been made to avoid irrigated cropland or to
minimize the impacts on such lands in those cases where avoidance is
impractical. No irrigated cropland exists on the subject site;
- The facility will not have an undue adverse effect on existing and
future development of the surrounding area as set forth in
applicable Master Plans. The existing and future uses are intended
to remain agricultural according to the Weld County Land Use Plan
Afap;
- The design of the proposed facility and Operation Standards mitigate
negative impacts on the surrounding area to the greatest extent
feasible;
- The site shall be maintained in such a manner so as to control soil
erosion, dust, and the growth of noxious weeds;
- The applicant has agreed to implement any reasonable measures deemed
necessary by the Planning Commission [o insure that the health,
safety and welfare of the inhabitants of Weld County will be
protected and to mitigate or minimize any potential adverse impacts
from the proposed facility;
• - All reasonable alternatives to [he proposal have been .adequately
assessed and the proposed action is consistent with the best
interests of the people of Weld County and represents a balanced use
of resources in the affected area;
