Be it Resolved by the Weld County <br />• Planning Commission [hat the application for: <br />CASE NUAlBER: USR - 603:83:66 <br />NAPfE: Weld County Engineering Department (Lehr Pit) <br />ADDRESS : 933 N, 11th Avenue, Greeley CO 80631 <br />REQUEST: A Use by Special Review Permit for an open-cut gravel pit (public <br />utility) <br />LEGAL DESCRIPTION: Pt. S`~ SEz, Section I, T10N, R67W of the Gth P.M „ Weld <br />County, Colorado <br />LOCATION: Approximately three and one Half (3.5) miles southeast of the <br />community of Carr; north of Weld County Road 120 and west of State <br />Huy 85. <br />be approved Eor the following reasons: <br />1. The submitted materials are in compliance with application requirements <br />of Section 25.7, 44.1, 44.2, and 44.3 of the Weld County Zoning <br />Ordinance. <br />2. It is the opinion of the Planning Commission that the applicant has shown <br />compliance with Section 25.8 et seq. of the Weld County Zoning Ordinance <br />as follows: <br />- Reasonable efforts have been made to avoid irrigated cropland or to <br />minimize the impacts on such lands in those cases where avoidance is <br />impractical. No irrigated cropland exists on the subject site; <br />- The facility will not have an undue adverse effect on existing and <br />future development of the surrounding area as set forth in <br />applicable Master Plans. The existing and future uses are intended <br />to remain agricultural according to the Weld County Land Use Plan <br />Afap; <br />- The design of the proposed facility and Operation Standards mitigate <br />negative impacts on the surrounding area to the greatest extent <br />feasible; <br />- The site shall be maintained in such a manner so as to control soil <br />erosion, dust, and the growth of noxious weeds; <br />- The applicant has agreed to implement any reasonable measures deemed <br />necessary by the Planning Commission [o insure that the health, <br />safety and welfare of the inhabitants of Weld County will be <br />protected and to mitigate or minimize any potential adverse impacts <br />from the proposed facility; <br />• - All reasonable alternatives to [he proposal have been .adequately <br />assessed and the proposed action is consistent with the best <br />interests of the people of Weld County and represents a balanced use <br />of resources in the affected area; <br />29 d <br />
