<br />., <br />Page 3 <br />Mr. Smyth <br />October 10, 1980 <br /> <br />Since the proposed future use of these ponds is for wildlife habitat, <br />pond shorelines and floors should provide for enough irregularity such <br />that a natural appearing system would be created. Such irregularity of <br />shorelines would be difficult to create by backfilling as proposed in <br />the application, and further, would most likely be more costly than if <br />shorelines ate created during excavation. Additionally, backfilling to <br />create shorelines would be difficult to plan, and volumes would have to <br />be calculnted which would show that sufficient material was available to <br />carry out such a scheme. <br />A buffer strip of at least SO feet,,should be lefC between the bankfull <br />stage of the ponds and all property adjacent to the area to be permitted, <br />and each ~ide of the intersecting irrigation ditches. Additionally, a <br />100 foo ~^vuffer strip should remain between the operation and St. Vrain <br />Creek. <br />8. In order to mitigate any possible effects on the hydrologic balance, <br />as a result of previous illegal activities, a 100 fooC wide buffer strip <br />should be created along [he South boundary of St. Vrain Creek, from the <br />bankfull stage of the creek on the previously affected land. The buffer <br />should be created to an elevation of at least 4823 feet and rip-rap should <br />be included along that portion of t)~e buffer adjacent to St. Vrain Creek. <br />Ril>-rapping would require a 404 permit from the U. S. Army Corps of <br />£n yi neers, however, since this recommendation (according to previous <br />conversations with Tom David and Wayne Smyth of Weld County) is similar <br />to that already recommended by the Army Corps, this should not pose a <br />major problem. Additionally a 50 foot wide buffer to an elevation of <br />4823 feet should also be created on the eastern perimeter of the previously <br />affected lands between the adjacent property owner's pond (John Slovek) <br />and the existing 7+ acre pond created by previous mining activities. <br />(t is anticipated that such Luffers will mitigate any possible increase <br />in the flood hazard to the adjacent property owner as a result of the <br />previous mining activities. AddiCionally, the buffer along the St. Vrain <br />should return stability to that portion of the creek as affected by the <br />pruvious operation. The proposed buffer strips could be modified if <br />a hydraulic study on the area would justify such modifications. <br />~ 9. The Division of Wildlife report states that "operations near the St. <br />Vrain should be avoided during peak wildlife use periods...occurring i~n <br />October-December and February-March. In light of that report, the staff <br />recommends that all operations remain at least 200 feet away from the <br />Creek during those critical periods, unless the Division of Wildlife would <br />allow for a closer operating range. <br />(cont'd) <br />
