6. PAYMENT TO THE LESSOR FOR WATER AND CONSTRUCTED ROADS LESSEE shall compensate LESSOR for LESSOR expense, if any, in obtaining water foc use in the washing of the MATERIAL removed from the PREMISES. LESSEE shall compensate the LESSOR at the rate of $1,000 per mile of road constructed to transport the MATERIAL off the PREMISES and over other property owned by the LESSOR. LESSEE, at LESSEE'S expense will construct cattle guards where roads cross fence lines. 7. LESSOR USE OF THE PREMISES LESSOR shall have the unrestricted use of the PREMISES for any and all purposes except for the production, stockpiling, processing and shipment of sand, gravel and rock therefrom during the term of this LEASE. However, in the exercise of such use, LESSOR agrees he will limit his use so as to in no manner interfere with or impede the operation of the LESSEE. The LESSOR shall not be responsible for any part of the gravel pit operation. 8. LESSEE'S REMOVAL OF EQUIPMENT Upon the termination of this LEASE, whether by lapse of time or by termination because of completion or operations, or otherwise, LESSEE shall have the right and obligation to take and remove from said PREMISES any and all machinery and equipment belonging to LESSEE within 90 days of termination, unless it is mutually agreed by both parties to leave such machinery and equipment for a longer term 9. TAXES LESSOR agrees to pay before delinquency all taxes and special assessments levied with respect to the PREMISES during the term ofthis LEASE or any extension thereof. 10. WRITTEN MODIFICATION ONLY No action of any the parties hereto shall be construed as an extension of the term of this LEASE or the creation of a new agreement unless the same in writing and signed by the parties hereto. I1. SUCCESSORS AND ASSIGNS This LEASE shall be binding upon and inure [o the benefit of the respective heirs, representatives, successors and assigns of the parties hereto.
