~. <br /> <br />SAND AND GRAVEL LEASE <br />`/ i~ <br />THIS LEASE, made in duplicate, this , day of December, 1998, by and between <br />John F. Craig III, Box 902, Limon, Colorado, hereinafter LESSOR, and Lyman-Richey <br />Corporation, a Delawaze corporation, dba Central Sand and Gravel, P.O. Box 964, <br />Columbus, Nebraska, hereinafter, LESSEE. <br />1. LEASED PREMISES AND TERM <br />LESSOR, in consideration of the rents, covenants and agreements of LESSEE, <br />hereinafter set forth, and in consideration of each and every act to be done by the parties <br />hereto, does by these presents exclusively let, LEASE and rent to LESSEE for a term of <br />four yeazs from the date of this document or until terminated as herein provided, a <br />certain tract of land situated in Lincoln County, Colorado, for the purpose of establishing <br />such sand, gravel, and rock pits as may be located and developed upon the following <br />described real property: <br />A tract of land located within the NWl/4 of SW]/4 of Section 27, Township 9 South, <br />Range 56 West of the 6th P.M., Lincoln County, Colorado, comprising approximately 30 <br />acres. Hereinafter referred to as PREMISES: <br />2. LESSOR'S WARRANTIES <br />LESSOR warrants he has marketable title to the PREMISES and he has good right and <br />lawful authority to enter into this LEASE and so dispose of the sand and gravel deposits <br />located thereon or thereunder the PREMISES. <br />3. LESSEE'S USE OF THE PREMISES <br />LESSEE shall have the full and exclusive right and authority to go upon said <br />PREMISES with its employees, trucks and machinery and such other equipment as may <br />be necessary for the purpose of taking and removing from said land the sand, gravel, and <br />rock, hereinafter MATERIAL, as it may desire. LESSEE, shall have full and complete <br />access to any sand, gravel, and rock pits over and across the PREMISES of the <br />LESSOR, including the right of ingress and egress thereto and therefrom across the land <br />owned by the LESSOR. <br />
