2.03.12 Newspaper Advertisement for Proof of Publication • A copy of the most recent newspaper advertisement follows. Copies of other newspaper advertisements are set forth in Exhibit 4, Proof of Publication. PUBLIC NOTICE Terror Creek Company, 1840 Highway 133, Paonia, Colorado, 61428, has submitted an application for a technical revision to the Colorado Mined Land Reclamation Division, for its mining permit No. C-83-059. The proposed revision will incorporate a revised sediment control plan into the permit, revise the identification of interests and make an incidental boundary change to the permit area all in response to the Division's mid-term review process. The Terror Creek Loadout is located immediately south of Highway 133 and immediately south of Bowie, Colorado. The Denver and Rio Grande Western Railroad and the North Fork of the Gunnison River are located south of the loadout. The Mine permit area is located on the U.S. Geological Survey 7.5 minute Bowie Quadrangle map within the following sections. Township 13 South, Range 91 West, 6th P.M. Section 15: E/2NE/4SW/4 south of State Highway 133 • and the NE/4SE/4 north of the railroad and south of State Highway 133 Containing 19 acres more or less. The surface of the permit area is owned by Terror Creek Company and the Denver and Rio Grande Western Railroad Company. A copy of the application is available for public inspection at the Delta County Clerk and Recorder's office, 5th and Palmer, Delta Colorado, and at the offices of the Colorado Mined Land Reclamation Division, 1313 Sherman Street, Room 215, Denver, Colorado, 80203, (303)-866-3567.
