Walther Ewecolive Dveaor Alkhael B. Long D~msion D~reaor As we discussed by telephone on November 2, 2000, the Division has begun its review of the Mamm Creek application but has not completed it. There are also decision and recommendation time frames and possible meetings and hearings involved in the application process. These are discussed in more detail later in this letter. 1 am sending you several documents a[ this time and will follow up with others as they become available. There are also a few items which need to be clarified. l.) Inspection Report, and Decision Due Date Enclosed is a copy of our October 17, 2000 Preoperational inspection report for the site. Please note, as discussed in this report, that the original decision due date of December 19, 2000 has been changed. The Division has determined that the application qualifies as a complex permit application, and therefore has extended the decision due date to Monday, February 19, 2001. ltis possible that if the applicant adequately responds to the Divisions concerns, and if a Board Hearing is required, this application may be considered during the January 24-25, 2001 Board Meeting. 2.) Public Comment Period The end of the original public comment period was November 9, 2000. Because of an error the newspaper missed a week of publication, therefore the end of the public comment period is now November 16, 2000. J.) Division Adequacy Review The Division has reviewed the hydrologic issues identified in the application. Enclosed is a copy of that review. Please note that there may be additional review questions concerning wildlife, stream channel and pit stability, possible Corps of Engineer comments and other questions. As we finalize these reviews we will send you additional materials. -1.) Formal Public Objectors At the end of the public comment period the Division must schedule a series of meetings (Informal Conference, Pre-Hearing Meeting and Board Hearings) if there are any formal objectors. You indicated during our phone conversation that you may wish to make further comments, but may not be interested in being.a formal objector to the application.
