On the legal description page for both warranties, I changed the acreage <br />figure from "2 acres" to read "9.8 acres (2 acres affected land)", to reflect <br />the permit area as approved by the Board. <br />3. On the financial warranty legal description, two commas were inserted <br />into the line describing the four quarter quarter Sections of the permit area <br />to divide "NW 1/4 NW 1/4 NE 1/4 NW 1/4 SW 1/4 NW 1/4..." into 3 quarter <br />quarter Sections as follows: "NW 1/4 NW 1/4, NE 1/4 NW 1/4, SW 1/4 <br />NW 1/4...". This now reflects the correct legal description for the permit <br />area. <br />Unless I hear from you to the contrary, I will assume that these corrections <br />meet with your and your client's approval. <br />Therefore, enclosed please find two signed copies of the mining and <br />reclamation permit for the Schmalz Construction Pit. Please note that the <br />stipulation concerning input from the Colorado Division of Wildlife is <br />attached as a rider to each permit copy.
