<br />Dear Party:
<br />DMG and the State Attorny General's Office (AGO), have reviewed the letter, submitted by
<br />Travis E. Stills, dated 1 /20/98, claiming that certain responses made by the applicant to
<br />DMG's adequacy review constitutes an amendment or technical revision to the Stone
<br />Gravel Pit application. Mr. Stills asserts that since the applicant's responses meet the
<br />regulatory definitions of an amendment or technical revision, DMG should extend the
<br />statutory deadline for consideration of the application. In Mr. Stills correspondence to
<br />DMG, Mr. Stills referenced the following correspondence: DMG 12/17/97 Adequacy fetter;
<br />the applicant's 12/22/97 response to DMG's adequacy letter; and the applicant's 12/8/97
<br />FAX transmission requesting an extension to DMG statutory deadline.
<br />Based on the AGO's and DMG's review of Mr. Stills letter of 1 /20/98, and the referenced
<br />correspondence, the Act, and Rules and Regulations, DMG has determined that as of
<br />today, item 5 of the applicant's 12/22!97 response to adequacy issues, addressing
<br />drainage channel reconstruction and the details of the proposed drainage channel indicated
<br />on the revised Exhibit F, Reclamation Map, constitutes a Technical Revision to the permit
<br />application.
<br />The Technical Revision is limited to item 5, drainage channel reconstruction and the details
<br />of the proposed drainage channel indicated on the revised Exhibit F, Reclamation Map, of
<br />the applicant's 12/22/97 response to adequacy issues.
<br />Pursuant to Rule 1.8.4111, DMG decision date has been extended and public comment
<br />period reopened, to ensure opportunity for public participation in the review of the
<br />Technical Revision. Public comment period commences today and will close on February
<br />12, 1998. Comments addressing the adequacy of the Technical Revision, must be
<br />received by the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango,
<br />CO 81301, FAX (970) 247-5104, no later than 4:00 p.m., February 12, 1998.
<br />DMG will consider timely submitted comments sner•ific to the proposed drainage channel
<br />reconstruction in our reconsideration of our previous approval recommendation of the
<br />permit application. DMG decision date for reconsideration is February 17, 1998.
