Albert of Agile <br />Stone Systems, Inc. wherein the Corps of Engineers validates the authorization of a nationwide permit <br />for the above referenced applicant. <br />Also enclosed is a copy of an excerpt of applicant's Mining Plan Map dated 12/11/97 showing a road <br />across the Tallahassee and a copy of applicants Exhibit D, CMLRB 112 Permit Application, Amended <br />Application, Page 12, pp1, stating that'Trafficwill use the pre-existing road across the stream'. <br />I would like to call to your attention to the fact that last year my husband and I frequently walked on that <br />land area (we had permission from the land owner to do so) and at that time there was no road across <br />the Tallahassee. Did Agile Stone Systems include this road in their permit application to you and if so, <br />why did you issue a permit for them to drive vehiGes across an area designated as wetlands? According <br />to the permR submitted to the Colorado Mined Land ReGamation Board applicant is planning to drive <br />heavy haul trucks across the Tallahassee Creek using this road. <br />In addition I am troubled by the timing of this permit issued to applicant. The above named map was <br />dated 12/11/97, one day a$e(the date on your letter. Am I correct in assuming that your pertnR was <br />issued based on the original application submitted by applicant? If so, I would request that you review <br />the Amended Application submitted by Agile Stone to the CMLRB for approval -the changes are <br />substantial and they incude this road across the streambed. <br />Thank you for considering my concerns.
