These <br />questions and concerns are set forth below, followed by the pertinent <br />response. <br />1. In Cotter's letter to you, dated September 12, 1979, responses to a series <br />of hydrologic questions were deferred until the completion of a report <br />prepared by an independent consulting hydrologist. These deferred ques- <br />tions and concerns pertain to the following: <br />(a) A description of the premising hydrologic conditions; <br />(b) Groundwater conditions as they pertain to pit inflow; <br />(c) A discussion of the postmining hydrology of the backfilled open <br />pit; and <br />(d) A summary of the effect of the operation on the hydrologic balance. <br />The attached discussion from Zorich-Erker Engineering, Inc., answers these <br />concerns. <br />2. The response set forth below addresses the concern expressed at the August <br />27 meeting between representatives of Cotter and the MLR staff, and is <br />listed as item number 7 in the previously submitted summary of that <br />meeting. <br />In response to recent communications between Cotter, the Colorado Air Pollution <br />Control Division, and the Air Programs Branch of the E.P.A., regarding air <br />emission permits, Cotter has filed with ttie state and the E.P.A., respectively, <br />dust emission calculations and a dust management policy statement, both of <br />which obligate Cotter to the use of a chemical soil binder for road dust <br />emission control. <br />
