Gydesen <br />Re: Lucky Strike Lode Mining Claim, U. S. Survey No. 9125, <br />Green Mountain Mining District, Gunnison County, Colorado <br />EXCEPTIONS AND RESERVATIONS <br />EXCEPTING the lien for general property taxes for <br />calendar year 1980 and all subsequent years; <br />Those EXCEPTIONS and RESERVATIONS recited in U. S. <br />Patent recorded June 14, 1895 in Book 121 at Page 169 of <br />Gunnison County public records; <br />EXCEPTING, also, right of access between subject <br />property and upon public road, street or highway; <br />RESERVING, however, royalty interest equivalent to <br />six and one-half (b z) percent of net smelter or other <br />mineral processing returns for merchantable minerals extracted; <br />And EXCEPTING, also, from grantee's right to use so <br />much of the surface as reasonably may be necessary in <br />connection with his mineral rights, the following-- 1) <br />easement for continued use by grantor, his heirs and assigns, <br />the existing seasonal residential structure, which structure <br />is approximately 25 feet by 30 feet in size, and which is <br />situated approximately 30 feet East of the Westerly <br />boundary of said lode mining claim and approximately midway <br />between the Northerly and Southerly boundaries of said <br />claim, and 2) easement for continued use of existing <br />Dorzweiler Family Cemetery, which cemetery is circular in <br />shape, with a radius of 25 yards, the center of which is <br />and shall be that certain monument marking the grave of <br />Mel Dorzweiler, and 3) easement and right of way over and <br />across the surface of said lode mining claim for purposes <br />of access to and from the aforementioned residential <br />structure and family cemetery. <br />
