The Adams County Board of Commissioners approved the above
referenced case subject to an agreement between Adams Agg-
regate, Inc. and the Adams County Engineer. Terms of the
agreement shall be as follows:
1. Granting of access to the South Platte River
in its present alignment.
2. Widening and improving the channel within
200 feet of its present centerline shall be
at the direction of the County Engineer.
3. Newly constructed dikes shall be a maximum
of 10 feet i^ height from existing ground
line.
4. Aiinimum construction for newly constructed
dikes shall be 8 foot top width with 1.5' to
1.0' side slopes.
5. Adams Aggregate, Inc. shall save harmless the
County and its officers and agents against
any and all damages to upstream or do«nstream
properties and shall save harmless the County
from any and all claims, demands, suits,
actions, or proceedings of any kind or nature,
or by anyone whosoever, in any way resulting
from or arising out of operations of Adams
Aggregate, Inc. his agents or subcontractors.
Signing of this letter will constitute a concurrence, of
the terms contained herein, between Adams Aggregate, Inc.
and the Adams County Engineer and will be binding on both
parties. The letter must be signed by an officer of the
company with full contracting authority.
