Traylor. M.D. <br />Exec ut rve Director <br />Our review of the application for Western Slope Carbon to backfill <br />coal mining wastes into Hawk's Nest Mine is complete. The non-toxic <br />• nature of Nalco 8873, used as a clarifying agent, and the extension/ <br />renewal of your Colorado Wastewater Discharge Permit Number CO-0033146, <br />make it possible to not require a permit at this time. The Rules for <br />Subsurface Disposal Systems exempt your type of facility from a permit <br />if you have a Colorado Wastewater Discharge Permit and are a non-pollut- <br />ing system. <br />There might be additional requirements forthcoming due to Colorado`s <br />pending implementation of the Underground Injection Control (UIC) program. <br />The present guidance ]fists your activity as a Class V well. At such time <br />that the UIL is implemented by Colorado and as a Class V well, you would <br />be authorized to operate by rule "until requirements under future regulations <br />become applicable" (See 40 LFR Part 146; p42512; 122.37 (a)(4)). The impli- <br />cation here is that there are future regulations, that apply to Class V <br />wells, forthcoming.
