Our review of the application for Western Slope Carbon to backfill
coal mining wastes into Hawk's Nest Mine is complete. The non-toxic
• nature of Nalco 8873, used as a clarifying agent, and the extension/
renewal of your Colorado Wastewater Discharge Permit Number CO-0033146,
make it possible to not require a permit at this time. The Rules for
Subsurface Disposal Systems exempt your type of facility from a permit
if you have a Colorado Wastewater Discharge Permit and are a non-pollut-
ing system.
There might be additional requirements forthcoming due to Colorado`s
pending implementation of the Underground Injection Control (UIC) program.
The present guidance ]fists your activity as a Class V well. At such time
that the UIL is implemented by Colorado and as a Class V well, you would
be authorized to operate by rule "until requirements under future regulations
become applicable" (See 40 LFR Part 146; p42512; 122.37 (a)(4)). The impli-
cation here is that there are future regulations, that apply to Class V
wells, forthcoming. Be advised that your application for subsurface disposal
of wastes will provide the necessary information to satisfy the current UIL
regulations for Class V wells.
