The conditions to the approval as the Division understood them to be worded by the Board, <br />are noted below: <br />Stipulation No. <br />Description <br />1. The operator will monitor two of the 15 individual or multiple spring sources that were <br />mapped by Azurite, Inc. Located on the north side of the Arkansas River on a <br />semi-annual basis for flow rate fluctuations and include the results of that monitoring with <br />the Annual Report. If a significant flow rate decrease is observed which is above 20% <br />and not associated with a dry season for the region, the operator must investigate the <br />cause of the drop in flow rate and also promptly submit a report of it's findings to the <br />Division. In addition, the two monitoring wells along the southern boundary of the <br />permit azea must be measured for static water elevation on asemi-annual basis and those <br />measurements included with the Annual Report. Any significant drop in static water <br />elevation that is not associated with seasonal conditions must be investigated and a report <br />of the results of the investigation must also be promptly submitted to the Division. <br />To address the potential contamination concerns from chemical methods for weed control <br />used by the operator, water quality tests will be conducted along with the monitoring of <br />the wells and springs provided for in this stipulation. The Division of Minerals and <br />Geology will develop for the operator a list of the water quality parameters the operator <br />will be required to test. The parameters will be limited to those associated with the <br />operator's use of herbicides in implementing it's noxious weed ( leafy spurge) <br />management plan. <br />
