Newport Street <br />Englewood, CO 80111 <br />RE: File No. M-99-058, Yule Quarry, 110c Decision Letter -Conditions, Financial and Performance <br />Warranty Request -Construction Material Operation <br />Dear Mr. Lcesby: <br />On July 30, 1999, the Division of Minerals and Geology approved your 1 lOc mining permit application. The <br />condirions to the approval are noted below: <br />Stipulation No. Description <br />The permitted operator will not conduct any mining or reclamation activities within that <br />portion of the 6.7-acre permitted area which lies wishing the White Marble #2 Placer Claim, <br />until the items included under Condition /!2 (below) are complied with. The ownership of the <br />above-mentioned portion of the permitted area lying within the While Marble #2 Placer Claim <br />is subject to change at a time subsequent to the approval of this 110 permit application. <br />However, the operator's right-ofentry is not completely precluded. By virtue of specific <br />lattguage in the present Deed of Trust held by dte operator, and pertinent to this placer claim, <br />the operator may enter upon such lands for other purposes. If the operator does not acquire <br />ownership of the White Marble #2 Placer Clatm, the operator needs to satisfy Condition #3 <br />(below), and not Condition #2. <br />2. At such time that the operator acquires ownership of the White Marble #2 Placer Claim, and <br />- prior to conducting mining or reclamation activities thereon, the operator shall provide to the <br />Division documents which establish to the satisfaction of the Division ownership of the <br />property, which invests in the operator the right to enter the property for purposes of mining <br />and reclamation. Once this is provided to the Division and found acceptable, Condition #3 <br />(below) will not need to be satisfied. <br />3. If the permitted operator does not acquire ownership of the White Marble #2 Placer Claim, <br />and is therefore prevented from obtaining the right to enter for purposes of mining and <br />reclamation on that portion of the 6.7-acre permitted area, the operator shall provide written <br />notice to the Division specifying that the operator has not acquired such ownership. Said <br />notice shall be submitted to the Division within five working days from the time the operator <br />fails to acquire ownership. Within one month after submitting such notice, the operator shall <br />submit to the Division the necessary documents which comprise a request to exclude that <br />portion of dte permitted area which lies on the White Marble #2 Placer Cla'tm. <br />
