The following issues need to be <br />resolved before the Division of Minerals and Geology (DMG) can consider approving your <br />application: <br />1) DMG is requesting a commitment to a specific seed mix for topsoil stockpile seeding. Exhibit <br />E, Reclamation Plan, states that vegetative cover will be established to preserve stockpiles. Rule <br />3.1.9(1) requires seeding of all topsoil stockpiles left in place longer than one growing season. <br />Please commit to this and to a specific seed mix and seeding rate for the stockpiles. <br />2) In Exhibit D, Mining Plan; please add the following: "If any subsurface water is encountered, <br />the Division and the Office of the State Engineer (OSE) will be notified immediately to <br />determine the best course of action." While it is not expected that any subsurface water will be <br />exposed, a written commitment to notifying the proper agencies is required. <br />3) Prior to construction of the stottrtwater channels to be cut into each phase, please provide <br />basic design information regazding channel sizing, storm frequency and permanency of the <br />channels to be constructed, so that we may confirm that the channels have been sized properly <br />for the stormwater requirements of the azea to be excavated. No construction of channels may <br />take place prior to Division approval. This is in accordance with Rule 3.1.6. <br />4) Exhibit S does not contain permission for the Operator to be within 200' of the telephone <br />lines, fiber optic lines, gas lines, Highway 6, and the railroad which run the length of the pit. <br />Until such specific written permission is obtained, or a geotechnical study proving that there <br />would be no significant damage done to the power lines is submitted, the Operator must remain <br />200' awav from these structures. This is in accordance with Rule 6.4.19. <br />
