Pursuant to the requirement of the Colorado Mined Reclamation Act"
co inform counties and certain municipalities of Development and Extraction
(i.e. mining) Permit applications filed with this office, please know that
Ni Valleu Pa ving has filed an
application for a Permit to do open pit mining of gravel
at the following Zega1 description: part of the NE% of the NEa of Section
4, Township 36 North, Range 8 West of the N. M. P. M., Conejos County
The applicant proposes to reclaim the site for agricultural .The
deadline for persons to file statements regarding this operation, or to
petition fot a healing before the Mined Land Reclamation Board to consider
the granting of a Permit is set by law; for information please call this
office.
Prior to Board approval the applicant's proposed mining and reclamation
plans must be in conformance with Local zoning ordinances, subdivision
regulations, or master plan. Pursuant to Sections 34-32-109(6) and
34-32-11.5 (e) of the Colorado Mined Land Reclamation Act, C.R.S. 34-32-IOZ
et sue., please inform the Mined Land Reclamation Division as to the status
of the above captioned site with regard to conformance with your Zoca1
zoning laws. The attached sheet is provided so that you might answer us in
a convenient, quick manner.
If we do not hear form you before March 23, 1982 we wiZ1 assume
that the above mining operation is in conformance with local zoning and land
use.
Also, the applicant is required to place a copy of the application for public
inspection with the Clerk of the county in which the proposed mine is•situated.
It is the Board's understanding that the Act intends For the application to
be made available For public review and comment in an area close to the mine;
it is not intended that it be made a part of public record by recording.
The Board is tentatively scheduled to consider this application on
March 24-25, 1982
