Box 10775 <br />Edgemont Branch <br />Golden, Colorado 80401 <br />Re: Open Mining Permit <br />Dear Mr. Case: <br />This is to acknowledge receipt of your letter concerning yocr <br />application for an Open Mining Permit with the Land Reclamation Board. <br />After our phone conversation on Febru.try 18, 1976, I reviewed the <br />Rules and Regulations again and dfsct:ssed them with Dr. Jeris Daniel- <br />son, Deputy State Engineer. While the wording of Section III, Para- <br />graph (F)(12)(a)(4), is somewhat misleading, the intent is with respect <br />to our regulatory functions where we issue permits for wells and certi- <br />ficates for dams which meet our statutory requirements. With respect <br />to your operation, if you have a permit for your on-site water requir=- <br />ments then you would enclose it with /our application to the Land <br />Reclamation Board. If you have no need for water, then a brief dis- <br />cussion on this subject should be submitted to this office in writing <br />along with your request for a statement from this office stating that no <br />permit or certificate is required (Paragraph 12(x)(5)). <br />The Land Reclamation Board has the option of requesting revl.cw <br />by our agency of the submitted materials in accordance with Section II, <br />Paragraph (c)(7). <br />If you have further questions, Nlease feel free to contact me. <br />Very truly. <br />HDS:mvg He%1//D(/.
