Serial No, C-13 b2 <br />continued public and coal operation access to the Dry Fork of Minnesota <br />Creek area: <br />Forest Development Road T11.2 - Dry Fork of Minzsesata Creek P,oad. <br />Forest Development Road T11,28 - Apache Rocks Road. <br />The non-system exploration road which junctions with the Apache Rocks Road <br />and goes in a gsnerally easterly direction to West Flatiron is r_ot open to <br />public,full-size vehicular traffic, but is necessary for continued <br />activities associated with coal mining in the West F1aC Iron area. <br />All three of these roads are granted exceptions. <br />For the p•, rose of: <br />The management of wetlands and floodplains are subject to Executive Orders <br />11990 aad 11988, respectively, the purpose of the BD's are to avoid to the <br />extent possible the long and short term adverse impacts associated with the <br />destruction or modification of wetlands and floodplains and to avoid direct <br />or indirect support of new con.,truction in wetlands wherever there is a <br />practical alternative. <br />Also, it '_s recognised that there is a direct relationship between impacts <br />on such areas and effects on water quality and aquatic ecosystems. There <br />is 'a high risk of irreversible and irretrievable impacts on the latter with <br />operation and developmer_ts in wetlands, floodplains aad riparian areas. <br />It may become necessary for a waiver, exception or modification (WEM) to. <br />this.etipulaticn for the operator/lessee to use the surface in the area <br />covered by this stipulation to' allow for the recovery of the coal reserve. <br />WEM's to this stipulation will be considered only at the time operations <br />are proposed, and will be subject to the Forest Land and Resource <br />Management Plar. in effect at the time of consideration, aad will be ~,il~ject <br />to applicable regulatory. and eavirorimental compliance requirements. <br />GXanting oP. a WEM is a Forest Service discretionary action which the <br />operator should not routinely expect. The Forest Service reserves the <br />right to impose other stipulations in the same area of Chis leasehold if a <br />WEM is granted. <br />Conditions under vhiah a Kffid may be granted: <br />If it can be shown through environmental analysis aad the application of <br />mitigation measures that the impacts to wetland, floodplain and riparian <br />resources will be minimized and that no other alternative location for <br />facilities and activities associated with coal mining is practical because <br />of environmental effects and operational considerations (eg, economics, <br />health and safety, etc,} <br />Any changes to this stipulation will be made is accoxdaace with the lased use <br />plea aad/or the regulatery provisions for auch~chnagee.
