(REVISID 3-9-93) <br />Berial No. C-1352 <br />CONTRIILLED SII8FAC8 IISE STTPQLATZ6N <br />160D8RAT8 GEOLOGIC HAZARDS <br />Surface occugaacy or use Sa subject to the following special operating <br />ooaetrniata. <br />Special interdisciplinary team analysis and mitigation plans detailing <br />construction and mitigation techniques will ha required on areas baring <br />moderate geologic hazards. {The interdisciplinary team could include: <br />geotechnical engineer, soils engineer, roads engineer, coal mining engineer <br />a_zd reclamation specialist.} ACCributes carstituting moderate geologic <br />hazard include stabilized earthflows, stabilized mudflows, stabilized <br />landslides; slopex adjacent to failed slopes or active earthflaws, <br />mudflows, or landslides and avalanche chutes; areas of rockfalls and flash <br />flood areas. <br />On lands described below: <br />All Or portions of SeC. 27, 28, 29, (3D-H L,M} , 32, 33, 34, T13S, R90W, and <br />a1.1 or pgrtions of Sec. 3, 4, 9, 10, T195, R9DW, Gth pM with moderate <br />geologic hazards as generally delineated on the attached map prepared by <br />Michael X..47ard on 12-i9-96. The map is for planning purposes. only. The <br />application of the definition of moderate geologic hazard to groun3 <br />conditions will determine whether the stipulation applies. In the event of <br />sry conflict between written clauses of this stipulation and the man, the <br />~L•ipulation clauseg shall control.. Ail National Forest System and Bureau <br />of i.and Management lands within the leasehold whit;: are classified as <br />having, moderate geologic hazards fall under jurisdiction of this <br />stipulation. <br />For the purpose of: <br />To insure the stability of facilities' required {such as roads, waterlines, <br />water tanks, powerlines, ventilation shafts, ancillary buildings, <br />drillpada, etc.) during the coal mining operations and to insure the <br />stability Of lands adjacent to these facilities. <br />it Q.ay become necessary for a.waivex, exception or modification {W&M1 to <br />this stipulation for the operator/lessee to use the surface in the area <br />covered by this stipulation to allow for the recovery of the cosl reserve. <br />WEM's to this stipulation will be considered only at the Cime operations <br />are proposed, and will be subject to the Forest ?.and and Resource <br />Management Plan in effect at the time of consideration, and will be subject <br />to applicable regulatory and environmental compliance requirements. <br />Granting of a 'ABM is a Forest Servioe discretionary action which the <br />operator should not routinely expect.
