According to your notice McStone Aggregates, LLC, has filed for an application <br />to conduct extraction of construction materials and reclamation, at or near Section 35, <br />Township 40N, Range 15W, 10th Prime Meridian, in Dolores County, Colorado. This <br />office requests more information regarding the application and historic operations at the <br />project site. According to the information supplied within your notice, it appears that the <br />project site contains waters of the US, including Plateau Creek and associated tributaries. <br />Under Section 404 of the Clean Water Act, a Department of the Army permit is required for <br />the discharge of dredged or fill material into a waters of the US. This office is concerned <br />that the proposed work or any pervious mining operations at the site may require a <br />Department of the Army permit from this office. According to our database, we do not have <br />We would appreciate it if you could provide this office with pertinent information <br />relating to impacts to waters of the US. If the project proponent can and has avoided work <br />within waters of the US, then this office does not have objections to the proposed project.
