<br />In order that right of entry to the proposed permit area be adequately demonstrated, either evidence of the <br />applicant's ownership of Lot 36 must be supplied or some other evidence of a right of entry to that property for <br />purposes of mining. As another alternative, the proposed permit area could be revised to eliminate Lot 36 but that <br />would entail corresponding changes in other parts of the application, i.e. initial pages and maps. <br />EXHIBIT J (Rule 6.3.10)): The applicant has provided evidence of mailing the required notices of the <br />application to the Costilla County Commissioners and Costilla Soil Conservation District. At this time, however, <br />evidence of receipt of these notices by these entities has not been provided. <br />~~ Prior to the Division's consideration of any approval of the permit application, evidence of the receipt of <br />the notices of the application by the Costilla County Commissioners and the Costilla Soil Conservation District, in <br />the form of the "green cazds", must be provided. <br />Note: As a result of a reconsideration by the Colorado Mined Land Reclamation Board o[ the corrective <br />action dates applicable to Notice of Violation MV-99-022, a permit for Pit 1 must be secured by November <br />26, 1999. In order to issue such a permit, the Division's approval of the permit application for Pit 1 must be <br />secured. As a result, the applicant's response to this adequacy review should be made well in advance of <br />November 26, 1999 in order that the Division have time to consider that response, deal with any remaining <br />concerns and then approve the application by the November 26, 1999 date.
