1 <br />EXHIBIT A (Rule 6.3.1): The Division is willing to accept the unmarked map with the listing of the <br />owners of the lots adjacent to and within 200 feet of the proposed permit azea, a permit area outline and a regional <br />location map as satisfying the requvements for Exhibit A. <br />~~c, The applicant should indicate in writing if this map is intended to serve as Exhibit A in the permit <br />application. <br />NOTE: The various materials supplied to address the requirements of Exhibit C (Rule 6.3.3) do not agree in <br />many instances. While the Exhibit C originally supplied provides acceptable answers [o some of [he <br />requirements, the Exhibit Summary received on 10/27/99 and the Exhibit E-Mine Plan Map received <br />10/29/99, apparently intended to revise responses given in the original Exhibit C, do not in themselves <br />address all the requirements. As a result, pieces of the Exhibit appear on three different documents. In order <br />that there be no misunderstanding by the Division of what is proposed by the applicant, a complete and <br />revised Exhibit C document bearing the acceptable responses to the requirements of the Exhibit but also <br />addressing the conflicts or deficiencies specified below should be supplied. <br />EXHIBIT C (Rule 6.3.3 (b)): The Exhibit C-Mining Plan information originally supplied appears to <br />indicate that no topsoil exists at the site, but the Exhibit Sununary dated 10/27/99and the information provided on <br />~i the Exhibit E-Mine Plan Map dated 10/29/99 indicate that 6 to 8 inches of topsoil will be salvaged for reclamation <br />purposes. None of these documents, however, commit the operator to stabilizing the topsoil stockpile. <br />The operator should make clear how much topsoil will be salvaged at the site for reclamation purposes and <br />commit to stabilize the topsoil stockpile. If to be stabilized by vegetation, the stockpile must be shaped accordingly. <br />EXHIBIT C (Rule 6.3.3 (d)): The original Exhibit C-Mining Plan submitted indicates [he thickness of the <br />deposit to be 30 feet; the Exhibit Summary dated 10/27/99 and the Exhibit E-Mine Plan Map dated 10/29/99 <br />~~ indicate the depth of the pit to be l4 feet. <br />The operator should make clearjust what the thickness of the deposit to be mined will be. <br />EXHIBIT C (Rule 6.3.3 (k)): The original Exhibit C-Mining Plan submitted indicates this requirement to <br />not be applicable and the other sources of Exhibit C information do not respond to this requirement at all. The <br />response requred here is not whether refuse and or acid or toxic materials will be exposed but how will they be <br />handled and disposed of if exposed. <br />The operator should properly respond to the requtrement. <br />EXHIBIT C (Rule 6.3.3 (1)): Here again, the original Exhibit C-Mining Plan submitted indicates this <br />requirement to not be applicable amd the other sources of Exhibit C information do not address this requvement at <br />all. The response required here is not if there will be an effect on the hydrologic balance, etc. but what measures <br />are to be taken to minimize disturbance to the hydrologic balance, prevent off-site damage and provide far a stable <br />©~ configuration of the reclaimed area. The response could, for example, refer to the fact that the pit appears to drain <br />inward which eliminates storm water runoff from carrying sediment offsite, that ground water is several hundred <br />lower than the mining level, and that the reclaimed slopes of the pit will be stabilized by vegetation, etc. <br />The operator should properly respond to the requrement. <br />NOTE: The application's responses to the requirements of Exhibit D (Rule 6.3.4) are made in the original <br />Exhibit D-Reclamatiom Plan together with lbe Exhibit Summary dated 10/27/99 and the Exhibit E- <br />Reclamation Map. Some of the responses are acceptable; some are in conflict; some requirements da not <br />receive any response at all. As a result, a completely revised Exhibit D should be submitted that responds to <br />all the requirements, eliminates the comflicts between the two sources of Exhibit D information and <br />addresses the deficiencies specified below. <br />EXHIBIT D (Rule 6.3.4 (I) (b)): Exhibit D in the original application indicates the reclaimed surface of <br />the pit will be "flat land". The Exhibit E-Reclamation Plan Iviap shows the maximum gradient of the reclaimed land <br />to be I:S. ' <br />The operator should respond in the revised Exhibit D with the proper gradient. <br />
