M-2001-001, CONSIDERATION OF A 112 CONSTRUCTION MATERIALS PERMIT APPLICATION OVER OBJECTIONS This Draft Pre-hearing Order is proposed to the Mined Land Reclamation Board ("the Board") by the Pre-hearing Conference Officer, W.T. Cohan, to govern the hearing in this matter. This Order, and amendments thereto, if any, shall be effective upon approval by the Board. FORMAL PUBLIC HEARING The Formal Public Hearing on this matter (unless noticed otherwise) shad be held before the Board on May 23 or 24, 2001, at the Centennial Building, 1313 Sherman Street, Denver, Colorado, Room 31.8, during the Board's regular May 2001 meeting. The Board's agenda (unless noticed otherwise) wilt begin at 10:00 a.m. each day. II. PARTIES The Pre-hearing Conference in this matter was held on May 15, 2001, in Dolores, Colorado. The Pre-hearing Conference Officer verified the following party list: . (See attached list entitled: "Parties to the Line Camp Pit Application."] The following objector parties were not in attendance, nor represented, at the Pre-hearing Conference, and therefore were not allotted time under Section VI of this Pre-hearing Order: Webb, Clifton, Clow and Sutherland. The parties should further note that if a party is not in attendance or represented at the final hearing in this matter, the objections raised by that party will most likely be deemed waived by the Board. • ,~~~ Note: The Division of Minerals and Geology ("the Division") shall not be a party, but shall participate in the hearing as staff to the Board.
