Wetland survey results are presented in Exhibit 16B, NW Mains Ventilation Shaft - <br />Waters of the U.S. Inventory and Wetland Delineation. <br />NMD (Panels 17 Right through 21 Right) (PR 03-06) <br />No new surface facilities are contemplated in permit revision number 6. Also, as part of permit revision 6, a section <br />of Fish Creek and its alluvial valley floor will be subsided and subsequently flooded. TCC conducted an Internet <br />search to determine impacts to raze and endangered plant species. Previously, Mr. Terry Ireland of the Grand Junction <br />Office of the USFWS was contacted to provide a listing of T & E species which could be present in Township SIV, <br />Range 86W, 6"' P.M. The results of the inquiry indicate that Sniranthes diluvialis (Ute Lady' Tresses) is the only <br />plant found within the area that could be potentially impacted if certain criteria are met. <br />The Ute Lady's Tresses occurs in habitats at an elevation of 6,500' or less. The disturbance associated with the <br />subsidence of Fish Creek and its AVF is located above an elevation of 6,500'. Therefore, TCC does not anticipate <br />any impact to any threatened or endangered plant species. <br />RULE 2.04.11 -FISH AND WILDLIFE RESOURCES INFORMATION <br />(1) Each application shall include a study of fish and wildlife and their habitats within the proposed <br />permit area and portions of the adjacent area as determined by the Division, or in the case of underground mining, <br />only those areas within the pronosed permit area and portions of the adiacent area as determined by the Division <br />where surface mining will be conducted or facilities located and the portions of the uermit area where effects on <br />such resources may reasonably be expected to occur. <br />(2) Prior to initiating such studies, the applicant shall contact the Division to determine what fish and <br />wildlife resources information will be required. <br />{3) The Division, in consultation with the appropriate State and Federal fish and wildlife mana eg ment, <br />conservation, or land management agencies having responsibilities for fish and wildlife or their habitats, shall <br />determine the level of detail and the areas of such studies, according to: <br />(al Published data and other information; <br />(b) Site-specific information obtained by the applicant; and <br />PR 03-06 2.04-61.1 03/02/04 <br />
