Pifher, Director <br />Water Quality Control Division <br />Colorado Department of Public Health and Environment <br />4300 Cherry Creek Drive South <br />Denver, Colorado 80246-2530 <br />Re: <br />Dear Mr. Pifher, <br />Di~isien of Minerals and Geology <br />Clean Water Act Section Year 2002 <br />303(d) Waterbody List <br />In an effort to wrap up the yeaz 2002 Section 303(d) listing process, we aze sending this <br />letter requesting further information on the State's list and asking that the State submit its final list <br />to our office. <br />The Colorado Water Quality Control Commission adopted the State's 20021ist on <br />September 10, 2002. >n correspondence dated September 11, 2002, the EPA requested information <br />from the State of Colorado for a series of waterbodies that were excluded from the State's final <br />2002 list. We requested data and information on these waters as well as "good cause" reasons for <br />excluding these waters/pollutants from the State's list. In correspondence dated October 31, 2002 <br />and in a number of subsequent communications we received the requested data and information. <br />With today's letter we aze requesting "good cause" reasons for excluding the waterbody/pollutant <br />combinations on the attached table. Please note that the attached table includes a number of <br />water/pollutant combinations that were not mentioned in the September 11, 20021etter, including <br />one water that was delisted as part of the Water Quality Control Commission's March 11, 2003 <br />action. <br />We are asking the State to provide good cause for excluding these waters/pollutants from <br />the State's list on a waterbody-by-waterbody basis. Section 40 C.F.R. Part 130.7(b)(6)(iv) allows <br />EPA to request such information from a state as part of the information sent to it to aid in its review <br />of the list. We encourage the State to submit the "good cause" reasons to us concurrent with <br />submittal of its final veaz 2002 section 303(d) list. <br />Within 30 days of receiving the list, EPA will take action on the list by either approving or <br />partially approving/partially disapproving the list.
