Natural P.eso_~rces <br />Thank you for your letter of inquiry concerning Mr. Charles <br />Webster's gravel operation. <br />You will find the regulatory authority for Forest Service <br />regulation for surface management of mining of Forest lands <br />in 16 U.S.C. - 551, 36 CFR 252.1 - 252.14 as ammended August <br />28, 1974 and recodified at 36 CFR 228 July 14, 1981. <br />We appreciate your concern in avoiding duplication of application <br />for Mr. Webster. However, as we explained to Mr. Webster, <br />until the ground is patented, it will be necessary to contend <br />with both State and Federal regulations when operating on <br />National Forest Lands. <br />In light of easing Mr. Webster's plight, the U.S. Forest Service <br />and the Mined Land Reclamation Bureau of Colorado, recently , <br />signed a cooperative agreement whereby the State and Forest <br />Service have agreed to accept a single bond for the two agencies <br />with the State Mine Bureau being the holding agency. <br />In the same vein, we had hoped to utilize the State's Reclamation <br />Plan in leiu of an Environmental Assessment to avoid duplication <br />and speed approval of Mr. Webster's Operating Plan which we <br />requested. <br />However, until we receive an Operating Plan from Mr. Webster <br />we cannot use the State Reclamation Plan or prepare an in- <br />house Environmental Assessment of the Plan. <br />azoo-n (I/as) <br />
