<br />W ITN E S S E T H
<br />LJHERE:IS, Adams County desires to conduct a(n) open "co~~"~
<br />operation, known as DEBETZ PIT fee the purpose of e:;cracein>; open
<br />mined sand and gravel
<br />WHEREAS, on September 24 19 78, Adams County 'FILED" an
<br />application,a reclamation plan and map, a~d the requ'_red fee, as requi.rec by law; and
<br />;dHERE4S, on December 21 19 78, the Mined Land Reclamation Boarc appro~td
<br />Adams County application and set bond; and
<br />WHEREAS, on December 21 , 19 78, the )tined Land Reclamation Board accepted
<br />surety submitted by Adams County and such date shal'_ to considered the
<br />dale of issuance of the permit and [he anniversary date for al] other purpeset; end
<br />4PrIEREAS, the t1ined Land Reclamation Board has made a finding, for the purposes
<br />of issuing t`i'_s permit, that:
<br />1) the application complies with the requirements of the Colorado
<br />Mined Land Reclamation Act and all applicable local, stag and
<br />Federal laws; and,
<br />2) the operation will not adversely affect the stability: o: any
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred Eeet of the affected land, e>:cept where thurc
<br />is an agreement between the operator and [he persons having an
<br />interest in the structure that damage tr, the structcre is to he
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried c~.t
<br />in conformance with the requirements of C.R.S. 19'3, 34-3~-116, as
<br />amended (1976 Sess. Laws H.B. 1065); and
<br />WHEREAS, for the purposes of issuing this permit, the operator has made a
<br />satisfactory showing to [he Eoard that he will employ during and after his
<br />open mining operations procedures reasonabl}' designed tc minimize
<br />as much as practicable the disruption from the open n:ini.ng operations
<br />and will provide for the rehabilitation of the affected land through the rehabilitation
<br />of plant cover, soil stability, water resources, and other measures appropriate to the
<br />subsequent beneficial use of such mined and reclaimed lands; and that in the event
<br />of the failure of his proposed reclamation plan, he will take whatever measures which
<br />may be necessary in order to assure the success of reclamation of the lands affected
<br />by his open mining operations; and,
<br />C7HEREAS, for the purposes of issuing this permit, a copy of the. application
<br />approved by the i•lined Land Reclamation Board of the State of Colorado is attached
<br />to this Hermit and thereby becomes a pare of the terms hereof.
<br />N041, THEREFORE, pursuant to the authority set forth in the Colorado ?tined
<br />Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, (1976
<br />Sess. Laws H.B. 1065) the Mined Land Reclamation Board of the State of Colorado
<br />hereby issues a life of the mine permit to Adams County to engage
<br />in °Pen mining Eor file purpose of e~:tracting op,,^
<br />mined sand S gravel on the follcwir.g parcel of ground, to '..it:
<br />W~ of the NF13t of Section 26, Township 15, Range 67 W of the 6th l~.m.,
