Rule 6.4.19 (Exhibit S) in part reads, 'Where the mining operation will adversely <br />affect the stability of any signfirant, valuable or permanent man-made structure <br />located within two (200) feet of affected land....'. <br />This site will bewet-mined which will generally preclude any issues regarding <br />side-slope stability of the pit walls that would °adversely affect' nearby man-made <br />structures. The divider box° and ditch leading to the box are owned and maintained by <br />the applicant The ditch will be utilized to convey Ft. The power line and well are owned and maintained by the applicant At the <br />dose of Phase 3 or the beginning of Phase 4, the power line and the well will <br />be dismantled and the area where the well is located will be mined. <br />c. The dike has been in place for many years and <br />~(a~f 7`~ ~ f d ` exists to keep out high spring flows or floodwaters of the Arkansas River from <br />~~~~ ~- . ~/flooding the agricultural fields. The dike is contained within the 200-ft wide <br />~~ f ~r ~~f7 riparian setback from the Arkansas River. An approximately 20-ft wide area <br />of non-disturbance wilt be maintained between the dike and the alive area of <br />mining. No adverse effects due to mining will occur to the dike. <br />f. The two wells and power line are owned and maintained by David Coulter, <br />f~ ~, ~ who is shown as the properly owner on Fgure C.
