'EXHIBIT N - Sou of Legal Right to Enter <br />AGR ENT FOR THE REHDVRL DF RGGREGATE <br />This agreement, when executed by the parties listed hereafter, <br />provides authority for Akron Ready Mix, 100 South Cedar, P. 0. Box J, <br />Akron, Col orada 80720, represented by Ronald E. Darrell, to remove <br />gravel from that portion of Surveyor's Creek located in the East Half <br />of the Southeast ~uartpr lEl/25E1/4) Section Ten (10), and the North <br />Half (NI/2) and Southwest Duarter (SWI/4) Section Eleven (11), Township <br />Two (2) North, Range Fifty-One (51) West, Sixth (b) Principal Meridian, <br />Washington County, Colorado, awned by William H, and Marilyn Elrick, <br />subject to the following conditions: <br />Rkron Ready Mix reserves sole rights to remove aggregates <br />from said property, and no other party has this right without <br />the mutual consent of both parties. This agreement shall <br />remain in effect for the life of the mine. <br />2. If, during any period when Akron Ready Mix is hauling, Mr. <br />Elrick has need for gravel, Rkron Ready Mix will deliver up <br />to one load per year to him without charge. If Mr. Elrick <br />has need for additional gravel, there will be no charge for <br />the gravel, and hauling casts will be worked out between <br />Akron Ready Mix and Mr. Elrick. Such gravel shall not be <br />included in computing payments to the El tick's. <br />3. Gates are to be closed at the end of each hauling day, and <br />between loads i4 there is livestock in nearby fields. <br />4. Access roads to and from the gravel pit are to be kept in <br />as good of condition as they are upon signing this agreement. <br />Use of said road shall not interfere with Mr. Elrick's <br />adjacent operations. Boundary lines of leased area will 6e <br />marked by Mr. Darrell. <br />5. Pricy per cubic yard of material removed, except as provided <br />in N2 above, is •1.00 through 1996, based on a September 3994 <br />Consumer Price Index of 201.4 for concrete products, as <br />published by the U.S. Department of Commerce. Future price <br />w111 by adj uated up or down as appropriate to reflect the same <br />rel atlonship to said Index, taking into account local economic <br />factors. <br />Akron Reidy Mix will attempt to remove at least 1000 yards of <br />mater! al per year from the lease area until the supply no <br />longer warrants this quantity. <br />Payment and record of yardage will be sent to Mr. Elrick, <br />40438 County Road KK-75/100, ^tis, CD 80743, at the end of <br />each month in which gravel is removed. <br />8. Akron Ready Mix will be responsible for obtaining any <br />environmental pr other permits relating to the removal of <br />gravel as may be required by State or Federal laws. <br />5ignede /~~ ---- <br />Ronald E.
