DANIELSON, DEPUTY STATE ENGINEER <br />SUBJECT: VALCO, INC. - ROCKY FORD EAST PIT, OTERO COUNTY, APPLICATION FOR <br />MINING AND RECLAMATION PERMIT <br />As requested by your office, we have reviewed the application fora gravel pit <br />near Rocky Ford. We cannot recommend approval of this application until the <br />following information has been provided to the Board: <br />1. Exhibit E, page 11, states that "no water is being used in the <br />reclamation operation" but Exhibit I/J, page 24, states that <br />"the planting will be irrigated until established." If irrigation <br />is required, the applicant must have water rights for this purpose. <br />2. Exhibit G, page 16, states "that there will be some evaporative <br />loss of water from the lake but that "it is not expected <br />that the on-going operations will cause measurable material <br />injury to senior water rights." The 26.98 acre reclamation lake <br />will perpetually evaporate approximately 94 acre-feet of water <br />annually from a river basin so over-appropriated that a demand <br />for water exists year-round. This evaporation will cause immediate <br />injury to senior rights on the Arkansas River and should be aug- <br />mented by water rights permanently attached to the property <br />through covenants, deed restrictions, or other legal means. <br />3. Exhibit G, page 17, states that "all uses of water occurring because <br />of the reclamation plan will be minimal as compared to the cantalope <br />crop being replaced." Using the Blaney-Griddle method for crop <br />consumptive use, we estimate that the historic consumptive use of <br />a 40-acre cantalope crop is approximately one half the evaporation <br />loss of the 26.48 acre reclamation lake. This historic consumptive <br />use will reduce the amount of augmentation water required if the <br />amount of water historically required for irrigation is released <br />to the river. Only the difference between historic consumptive <br />use and evaporation loss would then be required for augmentation. <br />
