.-
Three homes aze located at the base of the Rollins sandstone cliffs on the south side of the
proposed quarry and could be directly at risk from any materials dislodged by the
proposed mining and crushing operations. The letter (9-13-2005) from Ute Engineering
and Surveying Company provided by the Benson Brothers in their application "to review
affects (sic) on the slope stability" does not adequately address this problem. We request
that an appropriate geotechnical and stability analyses be conducted by the Division of
Geology and Minerals, or a consultant approved by your office, to ensure the safety of
these homes and their residents.
Exhibit G -Water Information states "The operation is not expected to directly affect any
surface or groundwater systems." However, in pazagraph (4) of this section the applicant
intimates they will apply for permission to use a residential well to supply the 6,000
gallons per day of water required for the operation. Coalby Canyon is presently served by
a private water company and numerous individual wells. During the recent drought the
private water company requested users to limit their water consumption to 3,000 gallons
per month. The withdrawal of 6,000 gallons per ~ from a well can certainly be expected
to affect the ground water system. Also, Exhibit G and the associated maps fail to
describe or show the existing pond located between the project area and Wazd Creek
Road.
Accordingly, as a resident of Coalby Canyon and an aggrieved party we object to the
issuance of a reclamation permit. We wish to be made a party of the proceeding, to be on
the mailing list, and request apre-conference public on-site inspection be conducted and a
pre-hearing be held in Cedaredge. Please schedule a hearing on the applicafion, for all the
reasons stated in this protest, and set the hearing in Delta or Grand Junction, a location
convenient to the proposed site.
Thank you,
Bill Welch
