i
' III IIIIIIIIIIIII III •
~CEIVED
NOV 12 1997
of hninerais a Geology
Ranch ~
of Flafchef
Division ufblincral &; Geo)ogy
131 ; 5hcr:n~t St. Rm. ^ 15
Denver, CO. 30303
re: Siloam Stone -Bedrock Mine #1 Application
Dear Sirs.
11/7/97
Red Creek Ranch is the surface o+vner of the ntajoriq~ of the land area under which
there is a i 12 operation application pending. Our comments regarding this application are
as follows:
1) Tite scope attd size of [his operation will adva'seh• effect our surlace rights and
the rwsnnably use of the property. In fact the applicant has slated that there evill be two
stace of operatiuo consisting of twenty acres at a time. ': he stage 2 a:•ea (137.17 acres)
has v~•tua'.ly fitlle or no value tiom a surtace stone extraction (see applicant comments pg.
I I ),vet the applicant would I'ue this whole area permitted. Recent violation by the
uppiirratts Icads r~s to Ixaieve that current utu:e operation of approxunateiy ~3. I acres was
clay pcrnut:ed for 9.9 acre clay mute and ttus was violated. We propose that [hc stage 2
area r~yuest lx denied sutce there is not arty real value that would give the state a viable
rctw'n. i'r.,puse.: S.:dc rv~r.::e es*.imat•~s based on this application would be $3900/ year
over a ~ yem• perod. This hasn't been achieved by the applicant over any period ui~ the
base (over 20 yrs.)
?I 1'he Siloa!n Stone operation has damaged one ofour access roads and we
weren't even contacted by 1`M. Mueller. Tlus type of operation reeds constant supervision
nut only by us but also your staff. The violations [hat have occurred surely do not warrant
:ut even b?g;;cr operation.
3) Ti:cre arc wetlands on the stage. two canyons' azcas west ofSiloant Road and on
the northerly part of section 36. No provisiut!s have bcen made by the applicant to protect
these areas.
7600 South I-25 Pueblo, CO 81004 Office: 719-564-6367 Fax: 719-564-7338
