Mr. Gilbert F. Rf~l~'1
-2- " April 20,•'1983
9. You mention that a topsoil ben~~ and riprap could be used as a sediment
control plan on the western side of the perniit area (across the Swale).
~~ The following questions come to mind:
1,~' a. Topsoil material could be lost if used for such a purpose.
~~., Would it not be better to construct such a bean out of the weathered
sandstone product?
b. You defend the position that the characteristics of the soils
i~,," indicate that such a berm is probably not necessary. If this is
~4w indeed the case, what considerations or situations would trigger
construction of the berm? If these conditions were evidence of
excessive erosion into the drainage,I submit that damage would be
'done by the time the decision to construct the berm was made. Please
clarify this situation further.
`j 10. The color of the asphalt plant is of much less importance to me then
~I1\ is its functional configuration. For example, will ponds be used and,
if so, how will leakage be prevented?
Exhibit E
6. Will topsoil be tested each time a phase is to be reclaimed, or
will the first soil test be assumed to be valid for all phases?
4 Different soil types may require different amendments, and the topsoil
l berm material may require unique treatment after its long storage.
Please clarify this matter further.
8. Reference my comments below under Exhibit L.
X11. Reference my comments above under Exhibit D.9.
Exhibits G and J
Reference my comments above under Exhibit D.9.
Exhibit L
The staging of the mining and reclamation, resulting in a calculation of
~~ expected reclamation costs is still not clear. At any given time, the
~k~° financial warranty must cover the plant area, the haul road, the topsoil
berm/stockpile area, the sediment control berm area (if any), the active
~,,s~~ry~ mining area, and the areas that have had reclamation work done on them,
~- but are not yet ready for release (e.q., graded, topsoiled and planted but
the vegetation is not ready to be released). Your cost breakdown does
not seem to fit this mode. Please discuss this matter further.
Exhibit N
I still have no statement concerning a possible fugitive dust perniit.
Please clarify this matter.
Please call me if I can make any parts of this letter clearer.
Sincerely,
n
~, art I/ i
Mark S.
