Rindalrl -S- ~•larch i?l, 19133
:~

c'
N~
~~
Exhibit J
This exhibit has statements strongly recrnnmendiny that the riparian zone
< not be disturbed and that drainage into this zone must be controlled. As
mentioned above, this is important and has not been adequately covered
(especially as concerns sediment control).
Exhibit L
As +nentioned above, the cateyories of disturuance (major, +noderate,
and minor) and the acreages comprising each have not ueen adequately
outlined. This +nakes analysis of the costs given difficult. It
appears tlrat• the costs only contemplate lU acres of total disturbance
at any or+e tine. This appears to be much ton low a fiyure. Please
clarify this matter.
2. Amore detailed cost break-down should be given for all the necessary
reclamation activities, given any new activities to be undertaken as
a result of the response to this letter. Ibis cost break-doom
should be more closely tied to a cost per acre or cost per activity
basis than it is now. Also, son+e of the costs given now seem low.
For example, seeding, mulching and crimpiny is given at $30.OU per
acre. The total cost indicates, however, that you meant ~3UU.OU per
acre. Even this fiyure seems low given prese+it costs. This should
, ,be broken down further, including such items as rakiny to cover seed
or drilliny.
Exhibit M
To date, our Uivision has received no proof of operator compliance with
El Paso bounty zoning. Please provide this or have the county provide it.
Exhibit IJ
Will the operator require a fuyitive dust permit for this operation? if
su, proof of the per+nit (or application for it) should be provided to Che
Uivision.
As you know, the Uivision must be provided with proofs of the four
sequential weeks of publication and notifications to all adjacent
landowners. this must be done before the hoard can consider this
application during the scherluled I\pril 27-I_t1, 19133 nieetiny.
Ns always, if you have any questions concerning any parts of this letter,
please call +ne.
S~i"ncerely,
Mark S.
