M1IRGIS <br />Re: The Robinson Brick and Tile Company <br />application for open clay mining <br />112 permit. <br />Dear Mr. Shelton: <br />The City of Lakewood has been requested to provide the <br />Mined Land Reclamation Board with a letter stating whether <br />the land use proposed by the above-referenced application is <br />in compliance with the City of Lakewood zoning ordinance. <br />The permit application indicates that the applicant <br />commenced clay mining operations in the subject area in 1947. <br />In 1946, Jefferson County adopted a zoning ordinance that <br />required certain action by the County's Board of Adjustment <br />in order to conduct mining operations. The City's review of <br />the County's records and of the City's zoning ordinances and <br />records since the City was incorporated in 1969 reveals no <br />evidence that the necessary actions have been taken to bring <br />the proposed mining operations into compliance with the <br />applicable zoning ordinances. <br />Therefore, based upon the information available to the <br />City, the proposed mining operations are not in compliance <br />with the uses presently allowed in the proposed mining area <br />under the City of Lakewood zoning ordinance. <br />
