The specific mining site is approximately five acres and located <br />north of Banner Road, just west of Highway 50 in the County of Montrose. A 100 foot <br />Union Pacific Railroad Right of Way borders the property on the west side. This Right of <br />Way contains an irrigation ditch approximately six feet wide (see boundary survey). HIS <br />Properties is proposing to excavate from the top of the bluff to a depth of fifteen using a 3: <br />descending slope. <br />I believe that mining activities on this property can be done safely and will have no <br />negative impact on the Union Pacific Railroad structures, as long as the following items are <br />implemented: <br />• Install and maintain a silt fence near the top of the bluff where construction activity <br />is occurring. The intent of this silt fence is to minimize effects from runoff storm <br />water and small rocks. <br />• Lower the edge of the bluff with a backhoe, pulling the material towazds the project <br />and away from the Rail Road Right of Way.
