may desire such information, and this provision shall constitute full authority in the absence of any <br />further express authority to such transporter to give such information to Lessor, its agents, or assigns. <br />10.2 Monthly Statements <br />For any month when coal shall be mined from property herein leased, Lessee agrees to furnish <br />to Lessor at its address to which payments are to be made as provided in Section 23, on or before the <br />25th day of each calendaz month, statements or reports showing the quantity ofcoal mined during <br />the preceding month and also showing the gross sales price received by Lessee for all such coal sold. <br />Lessee shall also show on said statement all other information used in determining the tonnage royalty <br />I <br />due from Lessee to Lessor on all coal sold hereunder. Such statements or reports shall be presented <br />in such a way as to allow Lessor to identify the lease on which it pertains. <br />Section 11. Lien for Royalties, Rentals and Other Payments; Other Liens <br />All royalties, rentals, and other payments herein provided to be paid by Lessee unto Lessor <br />shall be and always remain and constitute, until paid to Lessor, a Gen upon all property of Lessee <br />which shall be brought upon the Leased Premises, and upon the leasehold estate hereby created, but <br />only to the extent that such a Gen is granted to landlords by Colorado law. <br />Section 12. Lessee's Minin¢ Operations <br />12.1 Conduct of Mining -Plans <br />In every case in which Lessee opens and develops a new mine or makes any substantial <br />additions to the development of any existing mines, it will submit to Lessor, in advance of mining, the <br />plans of such proposed new openings and other improvements. Before commencing anyof its mining <br />operations hereunder, and as such mining operations progress, Lessee shall obtain from all <br />governmental agencies having jurisdiction and keep in force all necessary permits for its mining <br />operations and furnish and keep in force all bonds requved to be given. <br />12.2 Determinine Limits of Minable and Merchantable Coal <br />Lessee shall, in the course of its mining operations, fully and adequately test around such <br />portion or portions ofeach seam ofcoal being mined where such seam appears to consisi ofcoal that <br />is not minable and merchantable (and record on its maps, and give notice to Lessor oflits findings) <br />and based on the results of such testing shall reasonably and properly establish the extent and Emits <br />I <br />of such portion or portions oY said seam ofcoal, subject to the provisions of Sectiun 12.3. <br />12.3 Unminable Areas <br />If in the progress ofmining operations hereunder an area ofcoal should be encountered which <br />Lessee shall reasonably and properly determine is not minable and merchantable, and if~Lessee shall <br />promptly notify Lessor thereof and allow Lessor a reasonable opportunity to examine such area of <br />Page 6 of 17 <br />
