Colorado 51215-`!200 <br />Mr. Bob Oswald <br />Reclamation Specialist <br />Colorado Div. of Minerals ~ Geology <br />1313 Sherman St., Rm. 215 <br />Denver, CO 80203-2273 <br />Dear Mr. Oswald: <br />Division of Minerals r~ ueoiogy <br />It was recently brought to our attention by Mr. Marshal] Butler, Assistant <br />Planning Director for Fremont County, that you have some concerns about two <br />stipulations which we included in our permit for the County's proposed gravel pit <br />in Sec. 32, T 19 S, R 72 W. Perhaps I can clarify these requirements so that you <br />can proceed with the permit process. Specifically, the stipulations are: <br />Item a) "The final pit walls will be recontoured to a slope of 3:1 <br />(H:V) or lower, with the possible exception of the south wall, where <br />resistant bedrock may force a highwall. This south wall will be <br />benched or backfilled with material so that a slope as least as low <br />as 2:1 (H:V) can be achieved." <br />We have discussed this with Mr. Butler, and he has agreed to submit an amendment <br />to his reclamation plan to your office to cover this item. <br />Ztem f1 "Upon final reclamation, if stormwa[er infiltration <br />within the pit is not rapid enough to prevent the formation of <br />permanent mud areas, positive drainage must be provided to the north <br />into the natural watercourse. Conditions must be present for <br />vegetation to re-establish everywhere within the pit area." <br />This was a rewording of a stipulation used on other permits, and--upon further <br />consideration--is not necessary here, and may be misleading. Its intent was to <br />prevent any ponding which might inhibit natural revegetation. Our geologist <br />feels, however, that this will not occur in this situation; the rock material is <br />weathered syenite which is highly porous. The adjacent Glen vista pit, quarried <br />in the same material, has no ponding or drainage problems. we therefore withdraw <br />this stipulation, and I will send a copy of this letter to Fremont County for <br />insertion in their permit to this effect. <br />I hope this has addressed your concerns.
