We propose to continue well monitoring on a "once every three months" basis <br />after the first year of operations at the site. In aU likelihood, any mounding or <br />shadow affects to be caused by the proposed slurry wall will be noticeable within <br />weeks of completion of the slurry wall. As such, we do not believe that <br />monitoring of water wells on a more frequent basis than proposed will be <br />necessary. <br />Lastly, in our letter of response to your office regarding the Rivision's Third Adequacy <br />Review for the above referenced permit application, dated August 4, 2003, we had <br />raised issue with the Division's position that the Applicant would be required to submit a <br />Technical Revision for review and approval of the final French drain design and the <br />revised water study. In the time since that response was submitted, it has come to light <br />that the Division's position on the Technical Revision requirement is based on opinion <br />from the Office of the State Attorney General that such requirement would be necessary <br />in order for the subsequent and secondary approvals to be enforceable. While we don't <br />necessarily agree with the 5tate's opinion on this matter, the Applicant has agreed and <br />commits to submitting the requested information as Technical Revision's, par the <br />Division's request. <br />I hope that this additional commitment will allow for the Division's rendering of an <br />approval decision for the Heit Sand and Gravel Mine.
