r ~ III IIIIIIIIIIIIIIII
January 20, 1978
Don Rria
Mountain Mbbila Hix
P.O. Bo: 1966
BiPle, Colorado 81650
Dear Mr. Rris:
Oa 3anuary lJ, 1918, I diaewead the matter concerning your aaeumption
of the fihite Rivax Aggregates operation conducted under the Department of
Righways (DOS) option with the laadovner. there appears to be two vital
points controlling what magbbe done.
First, if say material is removed from the D0E portion of the operatioh
for uss 1a work you may be performing which is not a highway pro~sct you
should have full permission from the DOB. Zheir pit• era sat up for their
projects and woolly are not utilized by the contractor or other.peraone
for mate~laL needed is other construction without either lull permission
from the DOB, or a succession of operator.
Second, if you desire to assume this operation but operate your private
operation order the DOH permit you mwt wdezatand that nay violations vhich
might occur x111 caws the DOE eo be the responsible party, a situation
they may well not desire to involve themeelvee. 9iolatiana on their
operations era have very seriow consequences to the DOR due to the Tact
that until the violation is rectified they cannot receive permits on any
new operations. shay mwt we ell precautions to prevent such a situation.
My advice to qou !s if you desire to assume operations under the DOR permit
than a •pacifically idantilisd area be set aside strictly for a highway
materials source to which their permit applies. Areas for your private
operations should be conducted under a separate permit held by the private
company. I realize this Deans slot of work. but if the eariow legal
problems are to ba avoided it appears to w the operational areas mwt be
kept separate.
In summary, if you are aaeumiag the Nhite River Agg;egatee p~~ration :order
the DOB petmit for primarily private operations (Mountain Mobil M1z or
some other acme) wa will not rewmmand approval without either a clam
separation of DOH areas from yours sad esparate permitting, or a statement
from the DOB that they will be allwing you to conduct private operations
under their permit and that they will be responsible for insuring the
