Item # 11. The future land uses are recreation and rangeland.
Item # 12. The present land use is general agriculture.
2. Exhibit Q. The following were submitted to both the county commissioners
and the soil conservation district via certified mail, return receipt requested:
a. Cover letter indicating than an application has been submitted to the
DMG.
b. DMG's previous form letters . Except for a minor change in the
title of the form and the new rule citation, the language on the previous
`~ forms is the same as on your current forms. The post mining land use
indicated on both notices submitted was recreation/rangeland.
c. Copies of the application form.
3. Exhibit S. The mining operation will not adversely affect the stability of any
significant ,valuable, or permanent man-made structure located within 200 feet
of the affected land.
I am puzzled by the Exhibit S "completion" requirement and your suggestion
that republication would be necessary. Work was completed on this application in
December of 1995. In late December of 1995 and early January of this year I had
several conversations with Barb Chiappone to determine the status of new regulations
and forms. Since the Division had nothing in writing at the time, I was told that it would
be acceptable to work under the old rules and submit on the old forms and that this
would not be a problem since the Division was going to have a grace period for a
number of months.
1210 South Park Drive • Monument, Colorado 80132 • (719) 488-2769
