Canany
Grand Junction, Colorado 81SO1 .Acting Division DIreCIOr
Re: D Road Grav le Pt't, Application # M-2002-046, Comments Concerning Review Comments to
Mesa County Conditional Use Permit Application (CUP-2002-101).
Dear Mr. Elam:
This Office has received a copy of "Response to Review Comments" dated September 20`s, 2002
concerning the CUP application referenced above. A clazification needs to be addressed for statements
made in Item #1 under "Community Development' and "Division of Minerals and Geology".
First, The Colorado Division of Minerals and Geology (DMG) did not supercede the Colorado Mined
Land Reclamation Boazd (NLRB). The DMG serves as staff for the NLRB. Perhaps the statement was
meant to be the Mined Land Reclamation Division which was the name in the 1980's and early 90's.
Secondly, DMG may issue a reclamation permit prior to the issuance of other local, state and federal
permits. The Rules state only that the other permits must be annlied for, not necessarily received, by the
applicant for DMG approval. However, the Rules further stipulate that no disturbance can begin until all
permits have been acquired.
Although these may appear to be minor issues, it is important for documents open to public review to
contain the proper information to avoid any confusion.
If you need additional information, please contact me at the Division of Minerals and Geology, Grand
Junction Field Office, 101 S. 3rd St., Suite 301, Grand Junction, Colorado 81501, telephone no.
970.241.1117.
Sincerely,
G. Russell Means
Environmental Protection Specialist
