• SMALL AREA EXEMPTION <br />TOPSOIL STOCKPILE B-D <br />Topsoil Stockpile B-D is located on the south side of Bush Draw. The <br />stockpile is some distance from any of the existing sedimentation ponds <br />and is separated from the nearest ponds by the County Road and the Bush <br />Draw drainage. The stockpile is limited in size (0.32 acres) and <br />construction of a separate sedimentation pond to serve this structure <br />would involve significant unnecessary disturbance. Given these <br />considerations, Kerr proposes to establish a perimeter berm and ditch <br />around the downgradient side and the ends of the stockpile to capture <br />and retain the limited runoff and sediment contributions from the <br />stockpile area. Calculations documenting ditch sizing requirements are <br />presented on the following page. <br />The Topsoil Stockpile B-D area is small relative to total disturbance <br />area, and receives no discharge from underground mine workings. In <br />• addition, the proposed closed drainage system will provide effective <br />drainage and sediment control for this area, preventing any significant <br />adverse impacts on downstream water quality. These considerations <br />provide for effective compliance with applicable provisions of Rule <br />4.05.2(3). Therefore, Kerr respectfully requests approval of a small <br />area exemption for the Topsoil Stockpile 6-D area. <br /> <br />
