Permit Date: December 17, 2003 <br />Pemut No: M-2003-037 <br />The following additional stipulations and conditions form an integral part of the foregoing permit: <br />Stipulation No. Description <br />The operator will conunit to a maximum mining depth of 20 feet below the current surface level <br />once he has submits the required one (1) year of data for groundwater depth and receives written <br />approval from the Division to procced. The 20 foot maximum mining depth may be modified or <br />lifted after the Division reviews the data submitted. At no time shall the operator be allowed to <br />mine any closer than two (2) feet above the established highest groundwater level, regardless of <br />its height, without obtaining the applicable permits from all local, state and federal jurisdictions <br />first. <br />Operator will notify the Division 60 days prior to any disturbance in Please 3 or mining to a <br />depth over 20 feet so a Financial Warranty review can be accomplished. <br />A reportable spill is a spill of arty toxic or hazardous substance (including spills of petroleum <br />products) within the mined land permit area reportable to any Division of the Colorado <br />Department of Public Health and the Environment, the National Response Center, the Colorado <br />Emergency Plarming Commission any local Emergency Plaruring Conmtission, local <br />Emergency Piaruring Committee, or the State Oil Inspector. The Mine Operator shall notify the <br />Division of Minerals and Geology (DMG) of a reportable spill within the mined land permit <br />area using the same timeframe required by the permit, license, notice, statute, mle or regulation <br />governing the reporting of the spill to the other appropriate agency. Notice of a reportable spill <br />shall be FAXed to: Minerals Program Supervisor, Division of Minerals and Geology, FAX <br />(303) 832-8106.
