.. <br /> <br />(e) not excavate the dam site as shown on <br />Exhibit D, or conduct any operations on or adjacent to the dam <br />site which would jeopardize the structural integrity of the <br />proposed dam; <br />(f) contour all slopes no steeper than the <br />following: <br />(i) Areas in Reservoir Site No. 1 below <br />Elevation 8625 shall not exceed a 3-to-1 ratio (3 horizontal to 1 <br />vertical) and areas above Elevation 8625 shall not exceed a <br />2-to-1 ratio; and <br />(ii) Areas in the easternmost 200 feet of <br />Reservoir Site No. 1 shall not exceed a 4-to-1 ratio as shown on <br />Exhibit D; and <br />(g) not amend the MAI Lease, except to modify any <br />terms relating to (i) the computation or payment of royalties or <br />rental amounts or (ii) verification or determination of amounts <br />of materials removed from the Property, except to the extent such <br />terms apply to reclamation obligations on the Property, without <br />the prior written consent of Golden. <br />3. MAI Obligations Under Permit. Pursuant to the Mined <br />Land Reclamation Board Regular Permit Application for the Empire <br />Pit (the "Permit'), MAI covenants and agrees that it shall, on an <br />ongoing basis during the conduct of mining operations and after <br />termination of such operations (and such covenants shall survive <br />the termination of this Agreement and of mining operations on the <br />Property) <br />(a) grade all operational areas and roadways on the <br />Property to control the runoff of waste water; <br />(b) conduct all mining operations on the Property <br />in such a manner as to minimize harmful or polluting drainage of <br />water from the Property; <br />(c) subject to paragraph 4 below, remove, within 60 <br />days after the cessation of mining operations on the Property, <br />any plant offices, scale houses and other buildings used by MAI <br />in its operations; <br />(d) minimize surface damage to the Property caused <br />by the operation and storage of machinery and the construction or <br />removal of buildings; and <br />-4- <br />
